Britney Spears driving without a valid licence

Britney Spears will go on trial next month for driving without a valid license, court officials have confirmed.

The 'Toxic' singer, 26, and her lawyers had hoped to have the case - dating back more than a year - dismissed.

But a judge set a trial date yesterday for October 15th at Los Angeles Superior Court.

Facing court: Despite her legal woes, Britney Spears distracted herself with a night out at the Mondrian Hotel last night

Sources claim during the meeting in chambers the judge said he doesn't want to be criticised 'for giving Britney Spears special treatment'.

Britney is accused of not having a valid California driver's license when she bumped into another car in her Mercedes Benz in August last year.

Her lawyer Michael Flanagan argues Spears was driving with a Louisiana license that was valid because she owns homes in that state.

He revealed earlier this week he was planning to file a petition yesterday to ask the Superior Court to accept his proof Britney's license was valid.

Flanagan was hoping to have the case dismissed and for Britney to pay a $ 10 fee.

Britney was caught on camera bumping into the other car and driving off without leaving a note.

She was seen checking the damage to her own car from the fender-bender.

The owner of the other car filed a police report and Britney was charged with misdemeanor hit-and-run and driving without a valid license.

But the hit-and-run charges were dismissed in October last year after the chart-topper paid an undisclosed sum to the other driver.

The Department of Motor Vehicles confirmed Britney had never been issued a California license, even though she has had homes in LA for years.

State law requires drivers to apply for a license within 10 days of moving to California.

Britney passed the test to get her California license soon after her fender-bender.

Despite her legal woes, Britney was out and about shopping in Los Angeles yesterday.

Looking toned and healthy in jeans and a vest, the pop star spent time perusing the latest fashions in West Hollywood store Calypso.

Later that night, she met friends for drinks at the Mondrian Hotel bar, dressed in a little black dress, which showed off her toned legs.
